ORDER ACCEPTANCE POLICY
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. GalleryStreet.com reserves the right at any time after receipt of your order to accept or decline your order for any reason. GalleryStreet.com reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed over $500.00 ( USD ) may require a 50% deposit before services are renderred. We may require additional verifications or information before accepting any order. GalleryStreet.com is a manufacturer and reseller to both end users and resellers.
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, GalleryStreet.com shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. GalleryStreet.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, GalleryStreet.com shall immediately issue a credit to your credit card account in the amount of the charge.
MASTERPIECE GICLEE™ AND SUPPLIED FILES - TOLERANCES DESCRIBED
Reproductions of artwork may vary from the original piece of art for many reasons. All of Gallery Street's giclée prints are produced using aqueous-based pigment inks. Due to the difference in chemistry, an original piece of art which may have been produced using acrylic paint, oil paint, watercolor paint, oil pastels, pastels, mixed media, or any other medium other than aqueous-based pigment inks may differ slightly. This described variance from the original may be due to the reflective qualities of the medium, color gamut of the paint versus ink, white point dictated by the raw substrate, lighting used to present the piece, or any other physical aspect that may determine the way the human eye detects color. Gallery Street will always strive to closely match the original artwork provided by the customer. Color is a subjective quality that may cause differences in opinions. Gallery Street uses very advanced equipment for measuring color based on a standard set by the International Color Consortium (ICC). We profile our monitors, input devices and printers on a regular basis. If a customer provides Gallery Street with a digital file to print, they must understand that unless they have used hardware such as a colorimeter to calibrate and profile their computer's monitor or display, they may see differences in what their monitor showed versus what Gallery Street's printers printed. Supplied digital files are accepted, processed, and printed without any color management on Gallery Street's part.
Gallery Street is a producer of a very specialized print product. We are committed to customer satisfaction. Due to the fact that our orders are custom-printed and not in inventory, print jobs from customer-supplied digital files may not be returned. If a defect in materials is evident, the item may be exchanged for one identical item. However, we cannot take responsibility for typing, image, or design errors introduced by customers in the document creation process. In an effort to keep costs down and pass those savings along to our customers, Gallery Street does not review digital documents for content or spelling. If Gallery Street digitally captures an original piece of art and provides a Masterpiece Giclée™ print that does not match the original artwork within described tolerances, we will accept a return of that Masterpiece Giclée print for either a corrected replacement or a refund. This applies only to a print from which Gallery Street captured the original piece of art. This refund option also applies only to a first time order of that specific artwork title. If prints of the same title have been ordered in the past and NOT returned to Gallery Street by the customer, any subsequent orders must be accepted by the customer as is.
Gallery Street will TRY to cancel an order for you, if possible. Due to our fast turnaround times, most of the time orders cannot be canceled. We will make a great effort to cancel an order but remember once an order is placed it is basically final.
LIMITATION OF LIABILITY
In no event shall GalleryStreet.com or any of its subsidiaries or affiliates be liable for any indirect, special, incidental or consequential damages including but not limited to loss of use, loss of data, loss of business or profits. Some localities do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
CREDIT CARD PROCESSING
We do not charge your credit or debit card until your order is shipped, however we do attempt to get an authorization on your card for the amount of your order at the time your order is placed. This authorization is not a charge but still may utilize a portion of your credit limit or available funds making those funds or portion of your credit limit unavailable for other use. In the unlikely event that your order is delayed or cancelled the authorization will expire and your credit limit or available funds will again become available for use. The amount of time it takes for an authorization to expire is dependant on the policies of the bank that issued your card and ranges from 1 to 7 business days. Please note, credit card processing can take up to 3 business days (Depending on the accuracy of the information given to us by the customer.). Further, for security reasons, voice confirmation may be required before we can process your credit card for payment.
Gallery Street primarily uses Federal Express to ship packages and products to our customers. Transit times vary depending on which shipping service is utilized.
3rd PARTY SHIPPING
In the event a customer orders a product on GalleryStreet.com that is produced outside of Gallery Street's own manufacturing facility, shipping will be handled by the 3rd party and the appropriate information will be sent to the customer for tracking purposes. Never will an original piece of art sent to Gallery Street by the customer, be sent to any 3rd party manufacturer. Only certain products as described on our website such as mouse pads, mugs, tote bags, coasters, luggage tags, key tags, magnets, keepsake box, desk organizer, decks of cards, puzzles, stickers, post cards, folded greeting cards and calendars will be outsourced and shipped to our customers by a party other than Gallery Street. If a combined order is placed on GalleryStreet.com such as one puzzle and one giclée print, a customer will be charged shipping for both items as they are originating from different addresses.
Ground or Home delivery may take up to 7 days. FedEx 2-Day and FedEx Overnight are options that our customers may choose. Prices are dictated by destination zip code and service type.
Insurance is available for items shipped via FedEx. However, for artwork which has a perceived intellectual value incorporated within, FedEx will only cover up to $100 for Ground and Home deliveries and up to $500 for air services such as Standard Overnight and FedEx 2-Day service. Gallery Street will not be held responsible for any compensation beyond what FedEx pays on any given claim. If a customer would like to use a 3rd party insurance rider on any parcel sent to Gallery Street from the customer or any parcel sent to the customer from Gallery Street, the customer must take the appropriate measure to provide for coverage. In the event the customer would like a piece of original art shipped by Gallery Street to the customer, the customer must schedule a pickup at Gallery Street's location and cover all costs involved. In this case, Gallery Street will not charge for shipping, but rather will only charge any necessary packaging or handling fees.
